In 2020, Nintendo took legal action against Team Xecuter, as well as several resellers of their devices, accusing them of violating their intellectual property rights and circumventing technological measures. As part of the plea agreement, Bowser also agreed to cooperate with authorities in their ongoing investigation of Team Xecuter. In exchange for his cooperation, the remaining nine charges against him were dropped.

In February 2022, Bowser was sentenced to 40 months in prison for his involvement in Team Xecuter’s activities. Apart from the criminal case, he also faced a civil lawsuit from Nintendo, which accused him of three counts of copyright infringement and sought damages of $2500 per trafficked device, along with $150,000 for each copyright violation. In December 2021, Bowser agreed to settle the lawsuit by paying Nintendo $10 million.

However, Bowser was released from prison early in April 2023 due to his age, medical condition, and nationality. He returned to Canada, where he stated that he would have to pay Nintendo a percentage of his monthly gross income as part of the restitution agreement, estimated to be between 25% to 30%. He also mentioned that he may not have to pay the $4.5 million fine imposed by the court, as he had only paid Nintendo $175 from his prison earnings so far.
